On August 4, 2016, a Racketeer Influenced and Corrupt Organizations Act (“RICO”) class action lawsuit was filed in the District Court for the Central District of California against DirecTV, LLC (“DirecTV”) alleging that DirecTV used and continues the use the services of Lonstein Law Office, P.C. and/or Julie Cohen Lonstein, Esq. to contact small business owners for alleged unauthorized commercial use of DirecTV programming. Plaintiff alleges that DirecTV sends third-party installers to small businesses and offers promotional deals for satellite cable television services and equipment, intentionally signing business customers up under “residential” accounts without informing the customers that the services are not for commercial display. Plaintiff alleges that Lonstein Law Office, P.C. and/or Julie Cohen Lonstein, Esq. arrange for “auditors” to go to the businesses and observe commercial display of DirecTV programming. Business owners then receive a letter from Lonstein Law Office, P.C. and Julie Cohen Lonstein, Esq. claiming the business owners have violated their agreements with DirecTV as well as state and federal laws and offer customers to pay an amount of money to settle the matter or risk being sued by DirecTV. Plaintiff is seeking (1) injunctive relief enjoining DirecTV, Lonstein Law Office, P.C., and Julie Cohen Lonstein, Esq. from engaging in future violations of RICO, (2) damages resulting from DirecTV’s conduct, and (3) attorneys’ fees, costs, interest and other remedies available under the law. DirecTV, Lonstein Law Office, P.C., and Julie Cohen Lonstein, Esq. deny all liability and all of plaintiff’s allegations.

On September 30, 3016, DIRECTV filed a Motion to Compel Plaintiff Perez to arbitration. Plaintiff opposed Defendants' Motion. On May 1, 2017, the Court issued an Order denying Defendants’ Motion to Compel Arbitration. The significance of the denial of Defendants’ Motion to Compel Arbitration is that the Plaintiff and putative class members will get to pursue their claims in Court for now.
